Terms of Service

1. Who we are

ConstructoVista is a construction project management platform operated by NupaStack, a venture of the ADNK Group of Companies, based in Sri Lanka (“we”, “us”, “our”). By creating an account or using ConstructoVista, you agree to these Terms of Service on behalf of yourself and, where applicable, the company you represent.

2. The free pilot

ConstructoVista is currently in a pilot phase and is provided free of charge, “as is” and “as available”, without warranties of any kind. During the pilot:

• Features may change, be added, or be removed without prior notice.
• We do our best to keep the service available and your data safe, but we do not guarantee uninterrupted or error-free operation.
• We may contact you for feedback about your experience — that is a core purpose of the pilot.
• When paid plans launch, we will publish updated terms and pricing. You will never be charged without explicitly signing up for a paid plan.

3. Your account

You can sign in with an email address and password, or via Google or Facebook OAuth. You are responsible for:

• Keeping your login credentials confidential.
• All activity that happens under your account.
• Ensuring the people you invite to your company workspace are authorised to see the data in it.

4. Your data

You enter project, employee, attendance, material, and financial data into ConstructoVista. That data belongs to you (your company), not to us.

• We store your data solely to provide the service to you.
• We do not sell your data to anyone.
• You can request a full export of your data, or deletion of your account and data, at any time by emailing us (see Contact below).
• You are responsible for having the right to enter the data you enter — for example, your employees' details.

How we handle personal data is described in our Privacy Policy.

5. Acceptable use

You agree not to:

• Use the service for anything unlawful.
• Attempt to access other companies' data or probe the security of the service.
• Resell or sublicense access to the service without our written permission.
• Upload malicious code or intentionally overload the service.

We may suspend or terminate accounts that violate these terms. If we do, you can still request an export of your data.

6. Limitation of liability

To the maximum extent permitted by law, and reflecting that the pilot is free of charge, we are not liable for any indirect, incidental, or consequential loss — including lost profits, business interruption, or loss of data — arising from your use of, or inability to use, ConstructoVista. The figures ConstructoVista calculates (profitability, payroll, invoices) are tools to help you; you remain responsible for verifying them before making business, payroll, or tax decisions.

7. Ending the pilot

You can stop using ConstructoVista and request deletion of your data at any time. We may end or pause the pilot with reasonable notice, in which case we will give you the opportunity to export your data before it is removed.

8. Changes to these terms

We may update these terms from time to time — in particular, they will be updated when paid plans launch. When we make material changes we will notify you by email or inside the application. Continuing to use the service after changes take effect means you accept the updated terms.

9. Governing law

These terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, and any disputes are subject to the exclusive jurisdiction of the courts of Sri Lanka.
